A letter before action (LBA) is the beginning of our legal procedures. This letter provides customers with a 34 day period to respond otherwise we will look to begin the process of obtaining a County Court Judgment. You can read more about our legal processes here.
You will be able to send these LBAs to eligible customers through the dashboard of your PayItMonthly account or by using the links in the 'Legal Review' email you will receive on the first working day of each week if you have accounts ready for an LBA to be sent.
If you have missed the email or just want to check if any accounts have reached the stage where an LBA can be sent you can do this by logging into your PayItMonthly account and navigating to your signed Agreements.
Once here you may need to click the cog icon next to Agreements to open the Column Settings menu and toggle on the "LBA Task" setting.
Now the LBA Task column is visible you will be able to see in the LBA Task column on the right some accounts are displaying as "Legal action available".
If you have a lot of customers you may want to click the "LBA Task" header at the top of the column to sort your accounts in order of their tasks.
Once you have clicked either the link under the LBA task header or the link in your email as highlighted below you will be taken to the screen to complete the action.
Once you have clicked the link you will be taken through to the Actions page of the customers account. Here you can see confirmation of the customers remaining balance along with Estimated costs for the legal action.
At this stage we are only sending the LBA so only the first charge will be due and this will be deducted from your next payment. If we proceed with any court action down the road the court costs can be added to the customers account to be recovered.
If you would like to send the LBA to the customer then just click the green "Send Letter" button on the right and this will automatically send the LBA to the customer and begin their 34 day reply period.
If you do not want to send the LBA and would like the customers account to move into our Reduced Chase Cycle then click the Grey "Do not pursue" button.
